Elon Musk says SpaceX will sue FAA amid company facing fine for alleged launch, safety violations

Elon Musk said Tuesday that SpaceX will file a lawsuit against the Federal Aviation Administration (FAA), accusing the agency of “regulatory overreach.”

“SpaceX will be suing the FAA for regulatory overreach,” Musk said in the X post.

The tech billionaire's comments came after the FAA proposed fining SpaceX $633,000 on Tuesday, alleging that Musk's company “failed to comply with certification requirements” in connection with two launches last summer.

The agency alleged that SpaceX was fined $350,000 for using an “unapproved control room” for the June 18, 2023 launch and failing to take “appropriate measures.”[ing] Required T-2 hour vote.”

The remaining penalty, about $283,000, stems from Musk's company's alleged “use of an unapproved rocket propellant farm” during the July 28, 2023 launch, the FAA said.

According to an FAA press release, SpaceX requested revisions to its communications plan for the June 2023 launch and its blast site plan for the July 2023 mission.

“Safety is the primary focus in all the FAA's activities, including our statutory responsibility for safety oversight of companies that hold commercial space transportation licenses, and penalties apply when companies fail to comply with safety requirements,” FAA Principal Counsel Mark Nichols said in a statement.

According to the FAA, SpaceX has 30 days to respond to the fine.

FOX Business has reached out to SpaceX for comment on the proposed fine and Musk's social media posts.
