Diddy claims feds took attorney-client privileged documents from jail

Lawyers for Sean “Diddy” Combs this week accused federal agents of improperly seizing privileged material from his Brooklyn jail cell, but one legal expert said the privacy of inmates is limited inside the prison. It is said that this is a “weak'' claim that it has explained why expectations for the future have waned.

Combs' lawyers have accused prosecutors of fraudulently obtaining at least 19 pages of notes from his locker at a federal detention center in Brooklyn. It also contained “intact pages from two different legal pads,” an address book page, and torn pages from three other legal pads.

But Neema Rahmani, a former federal prosecutor who runs a private practice in Los Angeles, said anything that federal agents took from Mr. Combs and turned over to prosecutors could have been reviewed by a third-party team. It was found that it did not contain any expensive or privileged content. .

“Didi's only real chance of acquittal is to pay, blackmail or intimidate the victim into changing his story,” Rahmani said. “And prosecutors want to make sure that doesn't happen.”

Combs pleaded not guilty in September to federal sex trafficking, racketeering and other charges.

His lawyers argue that some of the material is protected by attorney-client privilege. A hearing on the matter is scheduled for Tuesday at 3 p.m., and his lawyer separately asked the judge to allow him to appear in court without shackles from now on.

The items were taken during a federal prison raid, which authorities have previously said was pre-planned and not connected to Combs' case.

Rahmani downplayed the claims of Combs' powerful legal team, which experts say faces an uphill battle given the severity of the case and the Justice Department's resources.

“That argument is weak because inmates don't have a Fourth Amendment expectation of privacy in prison,” he told Fox News Digital. “Guards can search his cell without probable cause or a warrant.”

Documents that may be privileged typically receive special treatment, he said.

“Federal authorities typically conduct investigations using teams of 'dirty' or 'dirty' investigators who have not worked on this case,” he said. “That way, viewing privileged material would not disqualify a 'clean' team from the case.”

Combs is scheduled to have a bail hearing Friday, the latest attempt to be released before trial. But prosecutors say he should remain in custody, accusing him of trying to pressure witnesses from behind bars.

“Prosecutors have reason to believe that Didi is obstructing justice by contacting witnesses from prison through intermediaries,” Rahmani said. “This is the same claim they made during their bail hearing, and I think they have evidence to support it.”

In court documents, his lawyers say the brutal assault on his ex-girlfriend Cassandra “Cathy” Ventura at a Los Angeles hotel, captured on video, was “a multi-minute act that showed a complex. It was a part of it,” he claimed. 10 year agreement The relationship between Mr. Combs and Victim-1. ”

Prosecutors have previously expressed “serious concerns” about the safety of Combs' victims and witnesses if he is released, and the judge overseeing his criminal case has issued broad rules restricting further accusers from coming forward. His request for a gag order was denied.

Judge Arun Subramanian said: “Koms authorities do not support gag orders that apply not only to trial participants but also to alleged victims and their lawyers.” “Local Rule 23.1 does not allow this type of relief. The limitations of that rule do not apply to witnesses, let alone future witnesses who have not yet been identified.”

Combs has been held in a federal prison in Brooklyn without bail since his arrest on federal sex trafficking, forced prostitution and extortion charges.

The trial is scheduled for May 5 next year. By then, the U.S. attorney overseeing his case could be replaced by President-elect Trump's nominee, former Securities and Exchange Commission Chairman Jay Clayton.

Federal authorities began their investigation in November 2023, when Ventura sued Combs, alleging physical and sexual abuse. They settled out of court the day after she filed suit.
