MSNBC legal analyst Christy Greenberg said Friday she would be stunned if Judge Juan Machan threw out President-elect Donald Trump's lawsuit following the president's decision to postpone the sentencing date indefinitely. He said he would.

“I would be shocked if Judge Marchand dismissed this case completely. It has no basis. In a very brief submission that the defense cited to legal authorities, he said that since Trump is going to be president again, he cannot accept the jury's verdict. “There was nothing that I had seen that suggested that just throwing it out should be the appropriate outcome,” she continued. “While I expect Judge Marchan to deny it, I believe it is our position to proceed with the case and that this sentencing will not take place until the end of his term.”
In a filing Tuesday, Manhattan District Attorney Alvin Bragg suggested delaying the remaining proceedings until the end of President Trump's term in 2029.
“The people deeply respect the Office of the President, are mindful of the demands and duties of the office, and recognize that the defendant's assumption of office raises unprecedented legal issues,” prosecutors wrote. “We also deeply respect the fundamental role of juries in our nation's constitutional system.”
Trump's lawyers claimed Marchan said Tuesday that the lawsuit must be thrown out immediately “to facilitate an orderly transition of executive power following President Trump's landslide victory in the 2024 presidential election.”
