‘No Moral Choice’: Dershowitz Says Biden ‘Must Pardon’ Jan. 6 Protesters After Granting Son Hunter Clemency

Prominent attorney Alan Dershowitz said Monday that President Joe Biden will be granted clemency after Hunter Biden, a nonviolent protester indicted following the January 6, 2021, Capitol riot. He said there was a moral obligation to pardon the people.

Biden announced he had pardoned his son. statement He was released Sunday night, claiming Hunter Biden was given “special treatment” and that “political opponents” were trying to “ruin” both him and his son. Dershowitz said Biden was right that people who lied about drug use when purchasing firearms “usually don't get prosecuted,” but he said Biden was right about the Black Lives Matter riots and Congress. He said the discriminatory treatment of those involved in the Capitol riot must be addressed. “Joe Biden was right when he said that no reasonable person would dispute the fact that he would not have been indicted if his name were not Biden,” Dershowitz said. I agree 100% with Joe Biden's clemency decision.” “I don't agree with this decision not to pardon people, and I certainly don't agree with him if he makes a decision not to pardon people on January 6th. We must forgive the people of the day.”

“He really has no moral choice because these people were indicted for who they are, not what they did,” Dershotis said. “If they were Black Lives Matter people and did the same thing, they wouldn't have been prosecuted. But they're not. They're Trump people. They're MAGA people, so if they did the exact same thing, they wouldn't have been prosecuted. He was indicted.”

Riots that erupted as part of Black Lives Matter protests in response to the death of George Floyd in police custody in May 2020 left at least 24 people dead and nearly $1 billion in damages. Property damage occurred. Dershowitz said that while there was violence in both cases, there were also nonviolent protesters.

“Neither were riots. They were unruly protests. Both had violent elements, and both had many nonviolent elements,” Dershowitz said. said. “I'm talking about non-violent people. I'm talking about people who just trespassed, people like my client who was there to protest. I don't agree with him. I myself thought the election was pretty decided. He didn't. He's a law student. He just wanted to protest and was then excused by the police. We were called by the police and it was videotaped.”

“This is far worse than what Black Lives Matter and Intifada protesters have been doing for years,” Dershowitz added. (Related: CNN and MSNBC repeatedly reassured viewers that Biden would not spare Hunter)

A Delaware jury in June convicted Hunter Biden of three felony firearms charges related to the 2018 purchase of a Colt .38 caliber revolver. The president's son pleaded guilty to federal tax charges in California federal court in September, just before his trial was scheduled to begin.

“I hate that cliché because it says no one is actually above or below the law to achieve equal justice, because most of these things are done according to the law. Because, for example, presidential immunity is done in accordance with the law, which the Supreme Court has said,” Dershowitz said. “As you know, the Constitution says that members cannot be prosecuted for what they say on the floor. Judges cannot be sued for what they do in court and not the Constitution, but the Supreme Court has said that. ”

“So let's understand what the rule of law means. The rule of law means that people on an equal footing should be treated equally based on the principles of law.” Showitz said.
