The federal judge overseeing Hunter Biden's tax crimes case is accusing President Joe Biden of “rewriting history” and violating the Constitution.
On Sunday, Biden shocked the political world by announcing a “full and unconditional pardon” for Hunter Biden. The pardon was not only shocking because Biden had repeatedly promised not to pardon his son, but also raised eyebrows because of its comprehensiveness. Biden pardoned his son for any crimes he committed or may have committed between January 1 and December 1, 2014. 1st, 2024.
To justify the pardon, Biden argued that Hunter was “selectively” and “unfairly” prosecuted, saying Hunter was given “special treatment” and was the victim of “selective prosecution.” he claimed. The president claimed that the only reason he was prosecuted was because Hunter was his son.
But U.S. District Judge Mark Scalsi said Tuesday that none of President Biden's claims are true.
Scalsi wrote in a five-page opinion: condemned Hunter Biden's lawyer accused the court of not providing a “true and correct copy of the pardon” in a motion to dismiss the charges against his client. In lieu of a pardon, Hunter's lawyers simply provided the court with a link to President Biden's statement regarding the pardon.
The “wording” of Biden's statement was “in tension with the case record,” according to Scalsi, and the statement was a central issue in the judge's order.
“Nowhere in the Constitution does the president have the power to rewrite history.”
In other words, Scalci believes Biden is lying — and used Hunter's own confession to prove it.
First, Scalsi addressed Biden's insinuation that Hunter was “one of those people who paid his taxes past due because of his addiction.”

Scalsi pointed out that the Constitution gives the president “broad authority” to grant pardons, but explained that “nowhere in the Constitution does it give the president the power to rewrite history.”
Scalsi explained that the main problem with the pardon is that Biden pardoned Hunter from all actions “until” December 1, 2024.
“The President signed the pardon on December 1, 2024. The period for acts covered by the pardon extends to the date of execution, so the warrant applies prospectively to acts that had not yet been committed at the time of execution. “The scope of the pardon power may be interpreted as such.'' Ultimately, Mr. Scalsi said he would abide by the president's wishes for a pardon, despite the constitutional issues.
“To the extent that a pardon includes future acts, the court considers the future element of the pardon to be separable from the element requiring termination of this proceeding,” he wrote. “The warrant clearly places the charges in this case within the purview of the pardon and demonstrates the President's intent to apply the pardon to this case, even if it is otherwise unconstitutional.”
