Despite bad facts, bad evidence and bad laws, President-elect Donald Trump on Thursday could make a mockery of our court system as Judge Juan Machan presides over a political trial. He persuaded just four Supreme Court justices to grant the motion to block the action. Systematic Sentencing Hearings in “The People v. Trump.”

Five votes were needed. And despite a recent ruling granting the president immunity from prosecution related to official presidential conduct, the majority ruled that Trump's objections could be addressed on appeal. The 34 charges of falsifying business records against Trump will be dismissed across the board by thoughtful prosecutors, regardless of political affiliation. It took prosecutors and judges with ulterior motives to succeed, and that's exactly what they got.

As a nation committed to justice and the rule of law, this criminal case is not only legally and procedurally flawed, but also poses a serious threat to judicial impartiality and public confidence in our criminal justice system. Unduly subordinating the judiciary to prosecutorial authority undermines its constitutional role as a check on government power.

Supreme Court denies Trump's attempt to halt New York sentencing V. Trump

Despite refusing to block President Trump's sentencing hearing, Chief Justice John Roberts warned of the dangers of disinformation and threats to judicial independence in his year-end report. Although Roberts did not specifically cite the Trump case, his concerns about the politicization of the judiciary should resonate with all of us. Manhattan District Attorney Alvin Bragg's actions are clearly less about securing justice and more about scoring political points against a former president whose policies and statements he opposes.

Simply put, this is unchecked prosecutorial abuse that will inevitably seep into courtrooms across our country and erode the vital role of fairness and consistency in our legal system. .

The judge's role is to act as a neutral arbiter and ensure that justice is served without bias or bias. In state and federal criminal justice systems, judges are the only real deterrent to prosecutorial abuses. Unfortunately, Mr. Marchand will no doubt continue to exhibit behavior that calls into question his own impartiality and reveals political motives. From delaying President Trump's sentencing until after the 2024 presidential election to his ridiculous attempt to distort Chief Justice Roberts' statement to implicitly defend his decision, Mr. Marchand is an unconventional and legal expert. took an unhealthy path.

President Trump says he respects Supreme Court's decision to deny request to halt ruling and vows to appeal

Furthermore, allegations of potential conflicts of interest related to Judge Marchand's family not only merit scrutiny, but also raise legitimate concerns about whether the judge intended to act impartially in this high-stakes case. There is. Judicial neutrality is the bedrock of our legal system, and any perception of bias, real or perceived, undermines public confidence in the judiciary.

Marchand's decision adds to a broader trend of judges not holding prosecutors accountable. By allowing this case to proceed despite its obvious flaws, Mr. Marchan is abdicating his responsibility, all of which increases the imbalance in our justice system.

The far-reaching implications of this case against Trump are not about any particular individual, but a litmus test for the health of our nation's criminal justice system. If the case is allowed to proceed, it would set a dangerous precedent that would allow prosecutors to pursue politically motivated cases with little fear of judicial oversight.

Worse, it suggests that judges may ignore their duty to objectively evaluate prosecutions, further politicizing the court and undermining its credibility. This case serves no one, neither the public nor the judiciary, and certainly not justice.
