The U.S. Supreme Court on Friday rejected President-elect Donald Trump's bid to halt a New York sentencing hearing in his business records case.
As Breitbart News reported on Wednesday, the president-elect has “filed an emergency motion with the Supreme Court to block his judgment in a business records case in which a New York jury found him guilty of falsifying business records.”
After the verdict, New York County Supreme Court Judge Juan Marchand set sentencing for Trump for Friday, January 10th at 9:30 a.m.
In the lawsuit, Democratic New York District Attorney Alvin Bragg accused Trump of falsifying business records by classifying payments to his then-lawyer Michael Cohen as business expenses rather than campaign expenses. Bragg claimed it was done to cover up his attempts to influence the 2016 presidential election.
Mr. Trump maintains his innocence and disputes both the course and outcome of the trial, which Mr. Marchand rejected last week.
Despite the upcoming ruling, Judge Marchand does not plan to impose any prison term on the president-elect.
On Thursday, the U.S. Supreme Court rejected the president-elect's bid to halt sentencing, with Justices Amy Coney Barrett and John Roberts siding with liberals.
Breitbart News senior legal contributor Ken Krukowski, who filed a brief in support of President-elect Trump, said, “This deeply disappointing ruling confirms that radical, partisan hacks of prosecutors are being used to the detriment of the nation.'' “This would allow violations of the Constitution that result in continued harm.” “The Supreme Court ruled last year that the president's denial of immunity has the right to be reviewed by an appellate court before the case proceeds, meaning President Trump's immunity claim should be considered before a final ruling. If the review could not be completed by President Trump's inauguration, the case should have been dismissed by January 20.
“Mr. Bragg committed multiple constitutional violations during his case against President Trump, and Judge Marchand made several additional irreversible errors,” Kurkowski continued. “The court could have stopped this travesty, and four justices voted to do so, but one single vote will ensure that this shameful episode in our nation's history will continue for some time to come. “The only silver lining to this horrific persecution of his political opponents is that President Trump can now appeal this matter,” he added. “He will have to take the case all the way to the U.S. Supreme Court, which could take up most of his upcoming term, but President Trump should eventually be able to overturn this miscarriage of justice.
