The jig is up.
The obvious slip and fall scammer tried to cash in by suing a Bronx supermarket after falling into a puddle in one of the aisles.
Now, even his lawyers have dropped him.
“My insurance will go all the way to the top because he's suing me, but I caught him,” Miguel Luna, owner of Fine Fur Supermarket in East Tremont, told the Post. . “I want to put this guy in prison.
“This will raise prices. But I don't want to do that. I don't want my people to pay more,” Luna said. “This will help everyone because they are trying to try this in other stores.
Video footage of the January 22 incident, obtained through the post, shows an unidentified person scoped out the scene, spilling water on the floor inside one of the aisles before leaving.
A few minutes later, an elderly couple is shopping in the same place when Felix del Aguilla stands up and starts grabbing bottled water from the shelf.
He places two 12 packs of bottled water and a large jug on top, then looks like he's falling on the ground, looking at the elderly pair for the last time.
Del Aguilla stands up and grabs his back, seen hobbing.
“He didn't look like he was injured,” said store manager Jeovany Perez. “It seemed he just wanted to leave. He didn't call the ambulance or the police.
“I was suspicious, so I went to look at the camera and saw who threw the water there. “When I checked, I saw what happened. Maybe it was because he was a scam. That's why he wanted to leave quickly.”
However, on February 2nd, the store told Big Apple's attorneys that Dell Aguilla would “pursuing a claim for personal injury that arises as a result of the accident.”
However, the lawyer who asked not to name him quickly dropped the del Aguilla after smelling the rat.
Despite repeated attempts, Del Aguilla could not be contacted for comments on Wednesday.
Court records show that he has filed at least one previous personal injury case that settled outside the courtroom.
Dell Aguilla alleged in her complaint that she was injured when she collapsed in a major food supermarket on Randall Avenue, the Bronx on March 24, 2017.
The lawsuit filed in September 2018 claimed that he caused “pain, shock, and mental anguish” and that the injury “becomes permanent” and “seriously injured.”
Suits cost quite a lot.
“Four years ago, my premium was $35,000,” said Pedrogo Ico, the owner of the store that runs business as a Golden Mango, headed to the Post on Wednesday. “It's $160,000 today.
“They take up to three years to submit, so wait a year or two before you go to court for the subpoena,” Goiko said. “We don't have any videos until then. There's nothing to prove our case. The insurance company says we'd rather settle it from the court than go to a ju trial.
“They are con artists,” he said.
