Third challenge filed to Trump’s order on transgender troops

Two transgender service members are suing the Trump administration over an executive order targeting implementation by transgender Americans and the US military.

The lawsuit was filed Monday Two transgender men in the US District Court in the District of New Jersey – Master Sergeant. Logan Ireland and Sergeant Staff. Nicholas Bear Baid – President Trump's executive order to declare government recognizes only two genders, male and female, and argues that prohibiting trans people from openly serving transgender service members on military subjects is “unequal, harmful and despicable.”

Ireland and Bade, represented by the GLBTQ Legal Advocates & Defenders and the National Lesbian Rights Centre, are challenged by Secretary of Defense Pete Hegses and Continental Minister Gary Ashworth to implement these orders.

According to court documents, Ireland and Bade are both U.S. Air Force members with 20 years of experience and began gender transitions more than a decade ago. They said they were each placed in administrative absent and could only continue their service if they follow their birth sex.

“But it is impossible for plaintiffs to serve as women, because each of them has a medical transition as a man and lives as a man,” the lawsuit said Monday. “And given the timeline of implementation published by the Trump administration, both plaintiffs reasonably fear that on March 26, 2025, an unwilling administrative separation procedure will be launched against them due to their transgender status.”

Pentagram for February 26th Policy Notesinstructed military leaders to begin identifying transgender service members within 30 days and to begin “separation actions” within 60 days.

The memo suggests a history of gender discomfort, like Trump's January 27 executive order on transgender forces – the serious psychological distress caused by a person's gender identity and gender discrepancy at birth, is incompatible with military service.

A military member diagnosed with gender discomfort could be retained “on a case-by-case basis.” However, service members must prove that they have never taken any measures to transition gender, demonstrating 36 months of stability along birth sex “without clinically significant distress.”

Trump and the executives have attempted to identify trans identity with a deception and cast trans people in the military as a threat to military preparation and unit unit cohesion. “It's a man's claim that he is a woman, and his requirement for others to respect this falsehood is not consistent with the humility and selflessness required of a service member,” Trump said. Presidential Order situation.

a 2016 Rand Corp. StudyCommissioned by the Pentagon, we found that allowing trans individuals to provide services would not have a negative impact on unit cohesion, operational effectiveness, or preparation.

Monday's lawsuit is the third to challenge Trump's executive order on transgender forces, and one of at least a dozen orders for his order on recognition of at least two genders alone will ask the court to stop the administration from implementing the order.

“Simply put, Irish Sergeants and Sergeants Bade have a constitutional right not to leave their military service based on their transgender status, a characteristic that has nothing to do with their fitness or service ability,” the lawsuit states.
