Fort Myers City Council passes enhanced ICE agreement after pressure from DeSantis

Fort Myers City Council fell under legal pressure from Gov. Ron DeSantis (R) and Attorney General James Usmier.

The vote for the 287(g) programme was not passed Monday in a 3-3 tie as council members who voted against it said there were questions they couldn't answer. The tie vote sparked fires nationwide as Florida department seemed reluctant to follow new state laws requiring them to work closely with the ice. Desantis and Uthmeier have raised the possibility of eliminating people from Congress or cutting state funds if they fail to approve the measures.

The 287(g) program allows local law enforcement officials to be ice trained and represented by the federal government to carry out immigration-related duties while on regular patrols and missions. Currently, Florida's state law is for the department to enter into a 287(g) contract.

Almost everyone who participated in public comments prior to Friday's vote urged the council not to pass an agreement to erode immigrant safety, illegal or legal, and trust with the city's police department.

Council members such as Darla Bonk and Diana Giraldo were still asking many questions about the program before voting in favor of the contract.

Bonk felt it was not enough to inform the council of the legal implications of the program, so he went until he accused the city attorney of not doing his job.

At ward meeting on Wednesday, Bonk said one of the reasons she originally voted was “A memorandum of understanding, as I understood on Monday night… [Fort Myers police] I'll be working for ICE, not a partner and ice. For me, that was a difference. I wanted more answers, so I asked for an explanation. ”

Bonk also said he is not sure how to protect officers from being personally sued if someone claims that they violated his fourth amendment right. She had many concerns before voting “Yes” on Friday.
