During the Fox News channel's “American Sunday Night,” House Speaker Mike Johnson (R-LA) noted the higher proportion of federal judges' injunctions issued to the Trump administration compared to other presidential administrations over the past 100 years.
According to Lousiana Republican, 62% of federal injunctions issued in the last century were opposed to Trump, and 92% of those issued by Democrat-appointed judges were opposed.
“It's okay, speaker, before you became a speaker, you were considered a constitutional expert,” host Trey Gordy said. “I think I still think so. You were the one your peers were watching when there were constitutional questions, and now there are a few. There's talk about branch integrity, branches, equilibrium, executive overreach, meaning the group sued Obama and Biden.
“I think it's to some extent,” Gordy replied. “I mean, I think you have a separation of power. There's checks and balances. There's three equal branches of the government. You're supposed to do this. This is this tug of war when you have difficult questions. For example, litigating a religious freedom defense case, I came across a judge appointed by Clinton or an judge appointed by Obama.
“So you know, I never came out of those courts thinking that I could bounce each of those judges,” he continued. “I got the appeals court as quickly as possible to overturn them, but now that I think we all have to admit, I think something is going on. You have a lot of activist judges. You were probably looking at statistics more than ever before. With partisan Democrats appointed, I think we have to deal with it.
