The presidential lawsuit, entitled “A Military Mission to Seal the Southern US Border and Repel Invasions,” directed the military to take temporary control of federal land, including Roosevelt’s reservation.
The memo was issued to Secretary of the Interior Doug Burgham, Secretary of Homeland Security Christie Noem, Secretary of Defense Pete Hegses and Secretary of Agriculture Brook Rollins.
Trump has directed Cabinet members to “take all appropriate measures” to take over jurisdiction over certain federal lands to the DOD, building border barriers and installing detection and surveillance equipment.

Under the lawsuit, troops stationed at the border are permitted to detain individuals who illegally cross the border.
“Our southern borders are under attack from various threats. The complexity of the current situation requires that our troops play a more direct role in securing the southern border than in the recent past,” the memo said.
As part of the early stages of the plan, the military will control “a limited sector of federal land designated by the Secretary of Defense.”
“Within 45 days from the date of this memorandum, the Secretary of Defense shall assess this early stage,” he said. “The Secretary of Defense may at any time extend activities under this memorandum to additional federal land along the tropical border and coordinate with the Secretary of Homeland Security, the assistant to the President and Homeland Security Advisor, and other enforcement departments and agencies where appropriate.”
The Roosevelt Reservation was established in 1907 by Theodore Roosevelt to protect the border, but immigrant advocates argue that Trump’s actions are illegal as the military is prohibited from participating in domestic law enforcement.
Aaron Reichlin Melnick, a senior fellow at the American Council of Immigration, accused the Trump administration of trying to get around the law.
He wrote in post Social media claims that “they are doing a Roosevelt Reservation Crazy strategy, giving them military “jurisdiction” across 60 feet wide land from California to Arizona, and that immigrants have been arrested for “trespassing military property.”
