The Fourth U.S. Circuit Court on Thursday rejected the Trump administration’s request to lift a judge’s order calling for “promoting” the return of Kilmer Abrego Garcia, a US man deported to an El Salvador prison.
“The Justice Department has appealed to District Judge Paula Sinis’s clear directive issued last week after the Supreme Court promoted the return of men in favor of the original order,” it reported. hill.
The Fourth Circuit refused to lift Shini’s order one day after the Trump administration applied for appeal. On a unanimous three-judicial panel, U.S. Circuit J. Harvey Wilkinson wrote that the appeal was “extraordinary and premature.”
“The relief the government is demanding is extraordinary and premature. We fully respect the robust claims of enforcement to the powers of Article II, but we do not subtly control the great district court’s efforts to implement the Supreme Court’s recent decision,” Wilkinson writes.
Wilkinson, the appointee of former President Ronald Reagan, even argued that the Trump administration had “assisted the right to hide the nation’s residents in foreign prisons, if there were no similarities in the legitimate processes that underlie our constitutional order.”
“It also argues that essentially it’s because it removes custody. This should be shocking not only to judges, but also to the intuitive sense of freedom that Americans still cherish,” Wilkinson added.
The Trump administration was able to seek an emergency relief order from the U.S. Supreme Court after receiving two denials from the Fourth Circuit in the Abrego Garcia case.
An immigration judge in 2019 ruled that Abrego Garcia could not be deported to El Salvador due to the risk of persecution. His lawyers called the deportation a “Kafka-esque mistake” and pointed out that he was not facing charges and was complying with our immigration requirements.
White House spokesman Caroline Leavitt has rebutted that the administration has “had been involved in human trafficking” and “proves reliable intelligence,” and he is said to be “the leader of the brutal MS-13 gang.”
“The administration maintains the position that this individual, who was deported to El Salvador and not returning to our country, was a member of the brutal and vicious MS-13 gang. “In fact, there is also a reliable intelligence to prove that this individual is involved in human trafficking. Abrego Garcia and his family have denied that he has any ties to the MS-13.
