Colorado Gov. Jared Police, D., announced Thursday that he had signed a measure to add a “gender” field to his national death certificate.
“The changes will be implemented by January 1. Supporters say the law will create spaces in forms to recognize individuals’ living experiences and coordinate records and death certificates from other states,” CPR News It has been reported.
The law, called HB 25-1109, created three options: “gender” for death certificates, including males, females and “non-binary.” Under the bill, the coroner, funeral director and others filling in their death certificates must list the “gender identity” of the deceased, according to the report.
“Coloradoans deserve to be aware of death,” said Kyle Brown, one of the bill’s sponsors, a Democrat, during the debate.
The death certificate maintains another category of “sex” in which the actual biological sex of the deceased person is listed. The report reportedly shows that both Republicans and Democrats agree that recording someone’s actual sex and important information is important “particularly for medical researchers.”
The report argues that the gender of death certificates is often “conflict with gender identity.” The report cites a 2021 review of the death record of 51 transgender and non-binary specific people in Portland, Oregon.
“California and New York allow people to be identified as non-binary death certificates, but most states do not,” the report said.
“Republicans argued that the law was a “deceit” and a violation of the First Amendment right. They also warned that Colorado could be a target for the Trump administration.
