Investigation into NY School District’s Gender Policy
The Civil Rights Office of the Department of Education has initiated a survey concerning Title IX compliance in the Saratoga Springs school district in New York. This survey has prompted guidance for schools, allowing students to determine their gender identity.
This move follows a letter from lawmaker Elise Stefanik (R-NY) to U.S. Secretary of Education Linda McMahon, indicating that the school district has resolved to oppose a Presidential Order from former President Trump that aims to separate men’s and women’s sports.
The resolution was adopted on March 27 and is titled “Affirming our support for all students.” It stated the district’s commitment to allowing participation in women’s sports and access to facilities, which directly contradicts the President’s directive.
The district’s actions have raised concerns about potential violations of federal civil rights laws and women’s dignity. In a statement, the board expressed opposition to the recent federal executive orders targeting transgender individuals and immigrant students, asserting that these orders conflict with foundational principles of inclusivity in education.
Notably, the district has indicated it will continue to honor the gender identities of students, allowing them to use facilities that align with their gender identity, and to participate in associated sports.
Secretary McMahon criticized this approach, emphasizing that such policies undermine the educational experiences of women and girls and violate federal standards.
Despite this federal guidance, the Saratoga Springs School District remains resolved in its support for transgender students. The district reiterated its dedication to “equity, inclusivity, and diversity,” despite federal pressures to conform to alternative standards in public education.
Furthermore, the district emphasized its commitment to ensuring that all students, including undocumented individuals, have access to education without the fear of law enforcement questioning them about their immigration status.
The Department of Education has sought further details from the district to understand its policies regarding women’s access to sports teams and facilities, including definitions of gender and gender identity.
Additionally, it has requested an overview of women’s sports teams where male students are allowed to participate.
