‘Malicious Prosecution’: Sanctuary Mayor Files Lawsuit Against Trump Prosecutor After Arrest At ICE Detention Center

Mayor Accuses Trump Officials of Misconduct in Detention Center Incident

The mayor of Newark has leveled accusations against officials from the Trump administration, claiming they improperly arrested him following an encounter at the Federal Immigration Detention Center last month.

This comes from Mayor Ras Baraka, a Democrat currently campaigning for the governor’s position in New Jersey. On Tuesday, he announced that top state prosecutors and a Department of Homeland Security (DHS) official were taken into custody on what he describes as baseless trespassing charges. Baraka contends that his constitutional rights were infringed upon by DHS agents Alina Haba and Ricky Patel.

“Today, I’ve initiated a federal lawsuit against Alina Haba and DHS agent Ricky Patel for false arrests, malicious prosecution, and related damages,” stated Baraka. He further noted, “They violently abused their authority to arrest me at Delaney Hall, even though I was invited inside. No one is above the law.”

The situation escalated a few weeks ago when Baraka tried to tour the Newark immigration detention facility. On May 9, he attempted to join New Jersey Democrat Robert Menendez, along with others, but was barred from entering Delaney Hall.

Video evidence shows a tense standoff between Baraka and ICE officers, culminating in his arrest on trespassing charges. Following the incident, the DHS responded by claiming Democrats had failed to follow the proper procedures and suggested that they had attempted to force their way into the facility.

“The actions of council members who attempted to enter detention facilities are more than bizarre political gestures; they jeopardize law enforcement and the safety of detainees,” commented DHS spokesperson Tricia McLaughlin. “Members of Congress can’t flout the law by illegally entering these centers.”

Baraka faced initial trespassing allegations from Haba, yet those charges were eventually dismissed; in turn, she accused Baraka of assaulting officers involved. Prosecutors alleged that the actions of the Democrats were an organized effort to interfere with the detention center’s operations under the guise of a visit.

Baraka, along with McQuiver, argued that these legal actions are politically driven by the Trump administration, as stated in her public remarks.

Local and federal officials are currently grappling with state laws that limit cooperation between local law enforcement and ICE agents. In May, the Department of Justice raised objections to several cities in New Jersey, including Newark, regarding their sanctuary policies.

Baraka’s announcement of his lawsuit coincided with the start of early voting in the New Jersey primary, where he finds himself among multiple Democratic hopefuls aiming for the nomination to succeed Phil Murphy. Trump’s endorsement of former Republican senator Jack Ciattarelli has positioned him as a significant contender against Murphy in the upcoming election.

The Justice Department has not yet responded to inquiries regarding Baraka’s lawsuit, although Haba released a statement expressing her awareness of Baraka’s plans to take legal action.

“A ‘surprising’ leak from Mayor Baraka’s camp indicates he intends to sue the Fed,” Haba posted. “I advise the mayor to focus on addressing violent crime and public safety – that’s far more beneficial for the citizens of New Jersey.”
