During a Senate Judiciary Subcommittee hearing on Tuesday, Cory Booker from New Jersey and Ted Cruz from Texas found themselves engaged in a fierce debate. The discourse arose amidst rising concerns over threats to federal judges, especially during President Donald Trump’s potential second term. Federal judges have been increasingly issuing injunctions against various presidential enforcement actions, which has heightened tensions.

The hearing, titled “Arguably the Most Dangerous Branch: District Judge vs Trump,” saw Cruz, the subcommittee chair, voice his discontent regarding perceived silences around judicial threats during the Biden administration. He highlighted the lack of response to threats aimed at conservative Supreme Court justices.

Booker swiftly countered Cruz’s claims, stating that such rhetoric is dangerous and merits attention. He pointed out that it was ridiculous for anyone to remain silent about threats to an individual’s home, recalling previous instances where he and others condemned attacks on Republican-appointed judges.

As the debate unfolded, Cruz aimed his criticisms at Senate Minority Leader Chuck Schumer and mentioned protests outside the homes of Supreme Court Justices Neil Gorsuch and Brett Kavanaugh. He characterized these protests as a violation of a federal law that forbids picketing in ways that could disrupt the justice system. Surprisingly, he noted that the Biden administration had not prosecuted anyone under this law.

Booker responded passionately, expressing frustration that Cruz accused them of being silent about the protests, when, in fact, they had actively condemned such actions and worked to ensure safety protocols for judges. He challenged Cruz’s assertions, wanting to clarify their bipartisan efforts to enhance security for judges.

The back-and-forth continued, with Cruz seemingly interrupting Booker multiple times. Booker urged Cruz to allow him to finish his thoughts, commenting that the intense partisan rhetoric only deepens the divides in the country. He insisted there’s a troubling narrative suggesting Democrats don’t care about the safety of judges.

Both senators exchanged sharp criticisms and defended their positions, with the atmosphere becoming increasingly tense as they navigated the complexities of law and order surrounding the judiciary. The hearing reflects a broader concern, especially in light of the Trump administration’s track record of criticizing what they termed “activist judges.” In fact, the former U.S. Secret Service reported investigating over 370 threats against federal judges since Trump took office.

As the hearing concluded, Democrats on the panel emphasized the need for the Department of Justice and the FBI to look into a growing number of threats, manifesting through unsolicited and possibly dangerous communications targeting federal judges.
