Change in Approach to Sanctuary Cities
Recent developments suggest that the legal hurdles faced by Sanctuary Cities might be coming to an end, largely due to an innovative initiative known as the Guardian Angel Operation.
This initiative, introduced by Bill Essay, the newly appointed U.S. attorney for the Central District of California, takes a straightforward approach to addressing the issues posed by these cities. The goal is to collaborate with federal immigration authorities to prevent interference in the deportation process of criminal illegal aliens who have been apprehended by local governments.
California designated itself as a sanctuary state in 2018, a move championed by former Governor Jerry Brown aimed at providing refuge for illegal immigrants. However, the groundwork for these protections was laid much earlier on a local scale.
In 1979, then-Los Angeles Police Chief Daryl Gates issued “Special Order 40,” which restricted police from inquiring about immigration status. Fast forward to 1985 when then-Mayor Dianne Feinstein enacted a law in San Francisco that made the city a sanctuary for asylum seekers. By 1989, local voters reinforced this commitment, ensuring that local law enforcement could not assist in deportations.
In the years that followed, legislation continued to tighten protections for undocumented immigrants. For instance, the “All All Procedures” ordinance passed in 2013 limited local law enforcement from notifying federal authorities about the release of illegal immigrants. Further amendments in 2016 increased these restrictions, effectively banning inquiries on immigration status altogether.
Concerns Over Crime
Given this background, it’s perhaps not surprising that California has attracted a significant number of illegal immigrants. Unfortunately, reports indicate that some among them have committed severe crimes, leading to tragic outcomes. Yet, lawmakers often choose to prioritize the community’s perception of safety over actual public safety, sometimes releasing offenders back into communities rather than coordinating with federal agencies.
Take the case of Kate Steinle, for example. She was killed in San Francisco by an individual with a lengthy criminal record who had been deported multiple times but was released by local authorities. This tragic story exemplifies the flaws within California’s Sanctuary Law, highlighting statistics that suggest a staggering number of crimes committed by illegal immigrants in the state.
This week, the Department of Homeland Security detailed the extent of Sanctuary jurisdictions across the country, revealing over 560 localities that release thousands of deportable criminal aliens annually.
Between 2021 and 2024, it is reported that 22,000 individuals were released from sanctuary city jails without notification to federal authorities. One notable case involved Jose Antonio Ibarra, who killed Laken Riley in a brutal attack. Riley was jogging when Ibarra, after being released from custody without federal notification, attacked her, resulting in her tragic death.
The practices in these Sanctuary Cities raise serious questions about compliance with federal law, specifically regarding local jurisdictions that hinder federal immigration enforcement.
A New Strategy
Fortunately, U.S. Attorney Bill Essay is taking action against this troubling trend with Operation Guardian Angel, which seeks to close loopholes in the Sanctuary City policies. Central to this initiative is the use of judicial warrants.
Essay has assembled a federal task force that includes various law enforcement agencies. The task force aims to obtain federal criminal warrants for undocumented immigrants arrested locally, requiring local authorities to comply without resistance. The operation has already yielded initial results, with multiple arrests made shortly after its inception.
As the task force gains traction, it is projected to make numerous arrests weekly, circumventing existing sanctuary policies. There is a growing sentiment that other U.S. attorneys could benefit from adopting this approach, restoring a degree of immigration enforcement that has been lacking in sanctuary states like California.
In summary, Operation Guardian Angel represents a pivotal shift in addressing the challenges posed by Sanctuary Cities, aiming to reclaim safety and enforce the law more effectively.
