State Sues Department of Justice over Transgender Athlete Directive

Lawsuit Challenges Gender Discrimination in Sports

A recent lawsuit argues that state regulations shouldn’t discriminate based on “biological gender.” The claim suggests that female students who enjoy athletic opportunities shouldn’t be impacted by any perceived discrimination tied to gender.

The lawsuit emphasizes that allowing athletes to participate according to their gender identity aligns with the government’s goal of ensuring all students can fully engage in school activities, including sports. This, they argue, could help prevent the significant harm transgender students face due to exclusionary policies.

As noted previously, an executive order was signed by the president that alters Title IX education regulations, threatening to withhold federal funding from schools permitting trans athletes to compete in women’s sports.

A recent poll indicated a large majority of Americans—around 79%—believe that trans athletes should not participate in women’s track and field events.

Attorney General Halham Dillon recently communicated with California, indicating the state must provide written certification by June 9th. The California Interscholastic Federation (CIF) oversees both public and private high school sports and mandates schools recognize gender identity.

Dillon stated that denying female students equitable opportunities due to the sexual protection clause could represent unconstitutional sex discrimination.

California Attorney General Rob Bonta criticized the Trump administration for urging schools to discriminate and infringe upon constitutional rights of students.

Bonta remarked, “The administration demands that California school districts violate the law and the Constitution or face repercussions. Just because the president is against the law doesn’t change anything, and we’ve shown that in court repeatedly.”
