WH resists giving executive privilege to former Biden aide Neera Tanden regarding Joe's mental sharpness

On Tuesday, a White House attorney stated that former aide Neela Tanden is not shielded by executive privilege and must give “unlimited testimony” regarding former President Joe Biden’s mental state.

This decision came just prior to Tanden’s appearance before a GOP-led House Oversight Committee, which is investigating aspects of Biden’s cognitive abilities and his use of an autopen.

Executive privilege allows the President to keep certain internal communications secret. This concept was frequently referenced by former members of the Trump administration during a Democratic-controlled Congress.

“After weighing the legislative and executive interests involved, we find that the demand for information represents a unique circumstance, where the interest in confidentiality is not as strong,” the lawyer noted.

He added that “President Trump has decided he will not assert any immunity that would prevent you from testifying before the committee.”

The legal counsel stressed that this investigation is “an exceptional situation,” aiming to assess the legitimacy of past executive actions.

Tanden served as a senior advisor to Biden from 2021 to 2023. Initially, Biden appointed her to head the Office of Management and Budget (OMB), but her appointment faltered due to opposition from former Senator Joe Manchin (I-WV) over issues related to her social media conduct.

Consequently, she became the director of the National Policy Council, focusing on significant policy matters.

During the end of Trump’s first term, several former officials sought to invoke executive privilege, particularly in relation to the January 6 investigation, to resist congressional subpoenas.

Notably, Trump’s former chief strategist Steve Bannon and trade advisor Peter Navarro resisted providing testimony or documents to the January 6 committee and faced charges for contempt of Congress, which led to their convictions.

The Oversight Committee has been conducting a broader investigation into the former president’s mental health and interviewing several former Biden administration officials to validate the legitimacy of his executive actions.

Future testimonies are anticipated from former senior aides Anthony Bernal, Ashley Williams, and Annie Tomasini, although none have been officially summoned yet.

Bernal, who previously served as the chief of staff for First Lady Jill Biden, is often viewed as a significant figure and is scheduled to testify on Thursday.

Additionally, Dr. Kevin O’Connor, who was Biden’s White House doctor, is set to appear for testimony on July 9.

In connection with the Biden Surveillance Commission’s inquiry and autopen usage, the Trump administration is involved in multiple related investigations.

Earlier this month, Trump instructed U.S. Attorney General Pam Bondy to initiate a probe into Biden’s autopen practices.

Biden has downplayed worries about his cognitive health, asserting that he was involved in all decisions that bore his autopen signature.

“I have made decisions on pardons, executive orders, laws, and declarations,” he stated.
