A White House spokesperson shared a statement regarding a Fox News digital report that involved a third-party investigation into fraud allegations against former San Jose volleyball player Blair Fleming. The Mountain West Conference has engaged the law firm Willkie Farr & Gallagher (WFG) to look into claims of conspiracy linked to Fleming’s teammate, Brooke Slusser, during a match on October 3. This firm is also tasked with managing aspects related to Fleming’s eligibility and addressing issues concerning trans athletes in women’s competitions.
Documents obtained showed that WFG’s attorneys not only investigated the claims against Fleming but also reached out to the university’s legal team to assist with navigating a federal Title IX investigation related to these matters.
The Trump administration initiated an investigation into this issue back in February, referencing the situation during the 2024 volleyball season campaign. The White House is currently focused on the developments highlighted by Fox News Digital.
“President Trump is dedicated to eliminating unfair participation by men in women’s sports,” stated the spokesperson, adding that he intends to take action against schools that compromise female athlete safety.
Fox News Digital has sought responses from both San Jose State University and the Mountain West Conference regarding the White House’s statement. Heafie, previously an investigative advisor for the U.S. House concerning the January 6 protests, was also mentioned in connection with this case.
Interestingly, WFG is connected to Doug Emhoff, husband of Vice President Kamala Harris, who joined the firm not long after Trump took office. Reports suggest WFG secured a $100 million contract with the Trump administration for various legal services, including support for veterans and tackling anti-Semitism.
With the appointment of a federal judge nominated by President Biden, the company succeeded in a legal battle surrounding the participation of trans athletes in women’s tournaments. WFG claimed a legal victory for Fleming just days after a previous appeal failed.
After the announcement of this legal win, the firm posted a press release online, although the page has since been removed. Fox News Digital inquired about this disappearance but has yet to receive a response from WFG.
Riley Gaines, a former University of Kentucky swimmer, is currently in litigation against the NCAA over policies regarding gender eligibility that permitted transgender women in women’s sports. The federal investigation led by the Education Department’s Civil Rights Office related to the handling of the situation at San Jose State is ongoing.
Cynthia Teniente Matson, the university president, has previously stated that San Jose State is willing to cooperate with the investigation, emphasizing their commitment to ensuring all students, especially athletes, are protected from discrimination.
Her statement stressed adherence to federal and state laws while navigating complex regulations, aiming to support students and foster an inclusive environment.
In early February, Heafie reached out to SJSU’s attorney after the initiation of their research regarding Fleming’s circumstances, offering to assist with the ongoing investigation. His offer was declined, but he followed up, expressing a willingness to help further.
