Representatives for former President Donald Trump have requested the Supreme Court to take action against a Boston judge who ignored the court’s ruling regarding deportations to other nations.
This situation escalated on Monday when the Supreme Court announced it would permit the administration to swiftly deport immigrants to countries other than their home nations. For instance, if China turns away immigrants, Trump’s representatives indicated that Chinese nationals could be sent to third countries.
However, activist Judge Brian Murphy declined to support this court decision. Murphy was confirmed by the Senate with a narrow 50-49 vote in late November, shortly after Trump’s election win.
Murphy stated on Monday that his jurisdiction over eight migrants being deported to Africa would remain unaffected by the court. His orders left the migrants stranded at Djibouti airport, where U.S. agents intervened to prevent their handover to South Sudanese authorities.
On Tuesday afternoon, the Justice Department urged the Supreme Court to uphold a specific deportation policy concerning Murphy. The department’s overview stated:
The district court’s ruling from last night represents a lawless challenge. This court needs to clarify that the district court’s enforcement order is invalid and must end the ongoing, irreparable damage.
The judge’s actions, described as a “rebellion” against the Supreme Court’s order, were criticized by officials. They argued that when one district judge openly disregards the Supreme Court, it undermines the rule of law and challenges the integrity of the judicial system, as expressed by Chad Mizzel, Chief of Staff to Attorney General Pam Bondy.
After the Supreme Court blocked the Boston District Judge’s interim injunction with a 6-3 decision, the district judge then asserted that business would continue as usual, stating that the injunction was still in effect.
Critics alleged that the judge was holding onto seven individuals charged with serious crimes, including arson, robbery, and murder, which fueled claims of an escalating issue within the judiciary.
The openly defiant stance taken by the Boston judge is seen as a significant escalation of problems in the judicial system.
