MSNBC Analyst Critiques Supreme Court Ruling on Trump’s Policies

On Friday, MSNBC legal analyst Melissa Murray shared her discontent regarding a recent Supreme Court decision that restricts lower courts’ ability to issue nationwide injunctions against President Donald Trump’s policies.

The ruling indicated that lower courts had overreached by suspending national restrictions on birthright citizenship. Murray, referencing the comments of Ana Cabrera, stated that this decision undermines lower courts’ capacity to hold the Trump administration accountable for actions she deemed “lawless” and “unconstitutional.”

“I think this is a really big win for the Trump administration. One major concern here is that if the court omits details about the 14th Amendment’s relevance, the narrative could easily shift to suggest that courts are upholding birthright citizenship,” Murray explained. “The reality is that the courts haven’t upheld it; they’ve simply created a situation where future lawsuits against birthright could be more complicated.”

Murray further emphasized, “This marks a significant triumph for Trump, essentially preventing the judiciary from intervening when the administration behaves unconstitutionally.” Justices Sonia Sotomayor, Ketanji Brown Jackson, and Elena Kagan voiced dissenting opinions.

Earlier in April, the Trump administration sought to challenge three lower court rulings that aimed to halt the implementation of the birthright citizenship ban, arguing that the Supreme Court should limit the use of universal injunctions on a national scale.

“During this entire process, the Trump administration has been focused on targeting undocumented individuals and complicating their legal recourse,” Murray noted. “Now, with this ruling, any resolution must be interpreted within each jurisdiction, making it harder for individuals to secure legal representation. This means fewer lawyers will step up to help them,” she continued. “Let’s be clear: This is a substantial victory for the administration, effectively putting them in a stronger position against those challenging their actions, ultimately striking a blow to the rule of law.”

On January 20th, Trump issued an executive order titled “Protecting the Meaning and Values of American Citizenship,” which aims to terminate citizenship for undocumented immigrants and their children who are on temporary visas.

Attorney General John Saul mentioned during a debate in May that approximately 40 universal injunctions have been issued against the Trump administration during its second term so far.
