Elie Honig Discusses How Diddy Might Still Face Harsh Penalties at Sentencing Even After Winning Key Charges

Diddy’s Legal Troubles: What’s Next After RICO Acquittal

CNN’s senior legal analyst, Elie Honig, discussed on Wednesday the potential repercussions for Sean “Diddy” Combs, even though he was acquitted of racketeering conspiracy (RICO). The jury found him not guilty on that charge along with two counts of sex trafficking, but he was convicted on two counts related to transportation for prostitution.

During an appearance on “The Situation Room,” Honig noted that a judge can take into account the conduct from which Combs was acquitted. This includes serious allegations involving violence, drugs, and firearms. He mentioned that it’s not uncommon—perhaps surprising to some—that a federal judge has this latitude during sentencing.

“This might be unexpected: a federal judge is allowed to consider acquitted conduct at sentencing,” Honig explained. “Even though Combs was only convicted of interstate prostitution, three months from now, when sentencing occurs, the judge could reference evidence of physical violence and drug use presented during the trial.”

He added that, while the current judge may not seem inclined to do so, it’s still a possibility. “Some might argue this is unfair to defendants,” he remarked. “But the judge could potentially impose a higher sentence based on that context.”

The prosecution painted a picture of Diddy using his power and influence to operate a sex trafficking network. They called on 34 female witnesses, including former girlfriend Cassie Ventura, who alleged she was drugged and coerced into attending “freak off” parties hosted by Combs. Additionally, court evidence included a video depicting Combs allegedly abusing Ventura in a hotel lobby back in March 2016.
