Bathroom Incident Sparks Legal Debate in Texas

In early 2023, Michelle Evans, the Republican Party Chairwoman of Williamson County, found herself in a surprising situation while in a women’s restroom in Texas, where she was attending discussions about gender reassignment surgeries for minors. She noticed a biological male using the facilities.

In a conversation with Blaze TV host Sarah Gonzalez, Evans explained the awkward encounter, stating, “We were just doing our business—washing hands, getting paper towels, and so on. Then, there was a guy washing his hands at the sink.”

While the man was in the stall, Evans quietly informed other women nearby, saying, “Just to be safe, there’s a guy here.” To make the situation a bit less tense, she even held the door open slightly as she exited.

Afterward, she approached the man, suggesting, “Next time, please use the bathroom across the hall. That’s for men.” Upon returning to the House Gallery, Evans learned that a post had appeared on Facebook about the incident. Feeling compelled to share, she tweeted about it, only to later have her phone confiscated by the Texas Department of Public Safety, per instructions from Travis County Prosecutor Jose Garza.

“I’ve been fighting against any potential criminal charges for sharing those photos ever since,” Gonzalez remarked.

Evans defended her actions, stating, “He was fully clothed, and his face wasn’t visible in the picture. I never identified him.”

On December 9, a three-judge panel from the Fifth Circuit Court of Appeals ruled that the investigation could proceed, indicating it didn’t violate her First Amendment rights. Although this wasn’t the outcome she had hoped for, Evans expressed relief and said, “It was quiet but heavy on my mind, so I was glad to have some clarity.” She mentioned receiving overwhelming support for her case from people across the nation and even internationally.

In their backing, the Global Government Affairs X account published a statement, expressing concerns that like, “The Fifth Circuit’s opinion permits a troubling criminal investigation to continue.” They continued, emphasizing support for Evans in her pursuit of an appeal.

Reflecting on the incident, Evans remarked, “It’s like a rocket to the moon at this point. There’s been a revelation, and people are starting to grasp that these situations are happening in Texas.”
