The Alabama Supreme Court has ruled that frozen embryos are children with human rights under state law, which has many implications for IVF.
The case arose from a 2020 case in which an unauthorized person gained access to embryos stored at a reproductive health center in Mobile, Alabama, destroying the embryos of three couples.
The couple filed suit in a lower court, which ruled that Alabama’s wrongful death law for minors did not apply to them. The couple then appealed to the state Supreme Court, which ruled 8-1 that the fetus is universally a child.
Allie Beth Stuckey believes the ruling makes perfect sense.
“There’s not a lot of consideration given to how life comes about, whether it’s moral or not, whether IVF is ethical or not,” Professor Stuckey says, adding that for those who believe life begins at fertilization, , it’s a little strange to point out that putting embryos on ice is a problem.
Frozen embryos are often left in the freezer, sometimes indefinitely, or discarded due to a change of heart or divorce.
Stuckey points out that IVF involves almost a eugenics process.
“Scientists and doctors can test these embryos to see if they have any genetic disorders or any special needs,” she says, adding, “Then, based on those results, parents can You can decide which embryos you want,” he added. To kill, to throw away. ”
“My basic thought is that that’s not the way to treat children,” Stuckey continues.
Celebrities like Paris Hilton have about 20 embryos on ice, but claim not all of them will be implanted.
“So, as you can probably imagine, I am disappointed in this Alabama Supreme Court decision that says these unimplanted embryos qualify as human children and therefore have the same rights as human children. ,” Stuckey explains.
