The sheriff's office said there was a “confrontation” between Spencer and Fosler.

Spencer is accused of shooting Vossler. Police said Vossler was pronounced dead at the scene.

Spencer was taken into custody and transported to the Lonoke County Detention Center.

Spencer posted bail and was released on Oct. 9, according to jail records. USA Today Reported.

The Lonoke County Sheriff's Office announced that Spencer has been charged with preliminary first-degree murder.

Lonoke County Sheriff John Staley said: video Shared on October 10th: “Currently, no formal charges have been filed. I have not filed any specific charges and have no intention of filing them.”

Staley added: “This is a tragic situation and our thoughts and prayers go out to everyone involved.”

Staley said the investigation is ongoing and “only limited details can be released” at this time.

On Friday, the sheriff told USA Today that Fossler was arrested by another agency in July and charged with internet stalking and sexual assault of a child. Vossler was scheduled to appear in court in December.

Fox News asked. If attorney Brian Claypool, a social and legal commentator, could have Spencer's murder charge quashed.

“Aaron Spencer's defense team will make a clear case for so-called fervent passion, and that's the defense in Arkansas,” Claypool explained. “And what that really means is that Spencer committed the murder in the midst of emotional turmoil.”

Mr Claypool added: “The heat of passion reduces a charge of first-degree murder or second-degree murder to manslaughter. That's going to be a big problem for Aaron Spencer, because that's what makes a conviction. It could make the difference between receiving a sentence and spending 30 years in prison or a life sentence.” The sentence is 5 to 20 years in prison. ”

Claypool noted that because of the confrontation between the two men, the defense could argue that his client shot Vossler in self-defense.

He emphasized that most self-defense laws nationwide apply when there is an “imminent threat of serious physical harm to oneself or a family member.”

Spencer's wife, Heather Spencer, said she had set up a GoFundMe campaign to help pay for her husband's legal defense, but the campaign has been canceled.

GoFundMe Terms of Use state: “Use the Services or Platform to raise funds or engage in fundraising efforts for the purpose of facilitating or engaging in the legal defense of financial and violent crimes, including money laundering, murder, robbery, assault, and assault-related crimes. You agree not to commit any crime, sexual offense, or crime against a minor.

Heather Spencer writes: facebook“We have been truly overwhelmed by the amount of love and support we have received since this incident. We keep saying we are individuals, because we are individuals. This has been posted on social media. While we hope and need the public's help with Aaron's case, we are still trying to process what happened to our child as a family. We are trying to do the best we can to get through this situation for everyone.”
