President Joe Biden and Vice President Kamala Harris’ Department of Homeland Security (DHS) released a Senegalese migrant into the United States from the southern border despite having detention space available to hold him. The migrant is now facing charges for raping a woman in New York City.
Papa Diop, a 38-year-old immigrant from Senegal, was arrested. Charged The New York Police Department (NYPD) announced that a man has been charged with first-degree rape after he allegedly followed a woman in the South Bronx, asked her for directions, then pinned her down on a park bench and raped her.
Diop was reportedly released onto U.S. soil shortly after illegally crossing the southern border near Yuma, Arizona, in May 2023. Claimed To New York Post Diop was released due to a lack of detention space.
Detention by Immigration and Customs Enforcement (ICE) dataData collected by Syracuse University’s Transactional Records Access Clearinghouse (TRAC) tells a different story.
The month Diop was arrested near the southern border, ICE had between 7,000 and 13,000 available detention beds.

Diop’s release into the United States despite available ICE detention space is one of thousands, perhaps hundreds of thousands, of cases in which immigrants have been released into U.S. communities rather than in ICE custody and have subsequently committed crimes against Americans.
For example, in the case of the rape and murder of 12-year-old Jocelyn Nangaray in Houston, Texas, Biden and Harris’ Department of Homeland Security released the two suspects, illegal immigrants, onto U.S. soil, despite there being thousands of empty beds in Immigration and Customs Enforcement (ICE) detention facilities.
Similarly, the suspected illegal immigrant accused of killing 22-year-old Laken Riley in Athens, Georgia, was released onto U.S. soil by Biden and Harris’ Department of Homeland Security. At the time of his arrest near the southern border, ICE had more than 8,000 detention beds available.
Harris, who is currently running for president, has previously vowed to dismantle already-restrictive ICE detention facilities funded by Congress.
During her 2020 Democratic presidential primary run, Harris pledged to “close down” privately run immigration detention centers on her first day in office. Federal government data shows that nine out of 10 illegal immigrants held in detention centers are held in private facilities.
