The Biden administration's attempt to remove razor wire installed by Texas at the border has been thwarted.

A federal appeals court on Wednesday blocked the Biden administration's effort to remove razor wire that Texas officials had installed along the U.S.-Mexico border.

State officials sued the administration after Border Patrol agents were ordered to cut wire fencing in Eagle Pass last year as part of Gov. Greg Abbott's border enforcement mission, Operation Lone Star. .

The Biden administration asserted that it had sovereign immunity and later argued that while the appeals process was underway, the wires thwarted federal efforts to rescue two undocumented immigrants who drowned earlier this year. But according to CNN, Texas disputes claims that the fence has harmed efforts to rescue migrants.

The Fifth Circuit Court of Appeals on Wednesday rejected the administration's claims of sovereign immunity, saying the state's actions “only had a minor impact on Border Patrol access and had no connection to the drownings.” It agreed with the lower court's ruling.

Two Trump-appointed judges ruled in Texas' favor, but one Biden-appointed judge dissented.

CNN reported:

Judge Irma Carrillo Ramirez, a Biden appointee, dissented from the majority opinion written by Justice Kyle Duncan and joined by Judge Don Willett, a Trump appointee.

The case is one of several ongoing immigration-related legal battles between Texas and the Biden administration, and could lead to a change in the Justice Department's stance once President-elect Donald Trump takes office. The Trump campaign has said it wants to work with Texas on border efforts as part of the next administration's plans for a broad immigration crackdown.
