Bryan Kohberger judge cracks down on ‘pervasive’ filings under seal in Idaho murders

Adda County Judge Stephen Hippler told both Idaho student murders that they would no longer have court permission to file many documents and many documents from the public's view.

“In this case, the broad practice of parties submitting material under seal has become standard, not an exception,” Hippler wrote in an order filed Monday. “Instead of trying to edit individual sensitive information, the entire document is submitted under seal. Furthermore, much of the material the parties are trying to seal is already in the public domain or simply not sensitive or sensitive.”

Bryan Kohberger's defense team and state prosecutors have compiled the compilation as they can request specific information, such as the name of the witness and the name of the victim's family, Hippler said. He also permits documents to be filed under seal if sealing is justified under Idaho Court Administrative Rule 32, which governs documents exempt from public disclosure.

“Parties must also seek the least restrictive way to protect information that should or should be exempt from disclosure,” Hippler wrote.

“Even though court concerns have been previously expressed, they continue to seek broad orders that seal the entire document in order to protect the identity of individuals, rather than simply using initials or requiring that an editorial version be released that discloses only the initials.”

The court will also continue to compile applications that include testimony from the Great Ju Court, as cases of the Great Ju Court are held confidential by default.

“I have never seen many documents sealed in criminal cases without actual legal basis,” said Nima Ramani, a former federal prosecutor and Los Angeles-based trial lawyer. “There is a strong presumption that court applications are publicly available.”

The incident is attracting a great public interest in the US and overseas, he said. As a result, he said that implementing many lawsuits behind closed doors could violate public interest.

“It would not be appropriate for a judge to issue blanket orders to spit out the victim's family and allow Carte Blanche to file everything under seal,” he said.

A few days after Coberger's arrest in connection with the Madison Morgen murder, Kayley Goncalves, Zana Carnordal, Ethan Chapin and Rata County Magistrate Megan Marshall issued their first gag order.

Both sides have justified using their orders of gags to justify not asking virtually questions about cases outside of court. As a result, almost all of the publicly known information in the case was included in the police affidavit sealed in January 2023 or through a court statement.

“There is little evidence that has emerged since the search warrant,” Ramani told Fox News Digital.

Kohberger was studying for his Ph.D. Criminology at Washington State University in Pullman, Washington at the time of murder. His apartment was at the University of Idaho, nearby Moscow, Idaho, about a 20-minute drive from the crime scene, with all four victims being undergraduate students. Each had been stabbed multiple times during a home break-in at 4am.

Under the body of 21-year-old Morgen, police found a knife sheath that prosecutors claimed to contain Coberger's DNA. Other known evidence includes telephone data and video showing suspected vehicles. It also includes testimony from a surviving housemate who saw a man with bushy brows leaving the crime scene and wearing a mask, possibly carrying a vacuum cleaner.

After Kohberger's indictment, the case was sent to District Judge John Judge. John Judge maintained his gag order by pleasing not guilty on behalf of the defendant in his arrest in 2023.

It went to Judge Hippler after the defense attorney argued and received the venue change.

Kohberger's third judge has recently made several moves in favor of transparency, confirming the transcription of a closed hearing on DNA evidence in January, and ordered the court to make audio recordings available at other sealed hearings held previously.

Kohberger's trial is scheduled to begin in August and could take up to 15 weeks. If convicted, he could face death penalty.
