California joined several other states on Friday that sued the Trump administration over a policy banning “diversity, equity and inclusion” (DEI) in federally funded schools despite its own proposal 209.
In early April, the Trump administration’s Department of Education ordered the state to prove that the state and their local school districts were following federal civil rights laws that do not use “illegal DEI practices.”
On Thursday, a federal judge blocked policy in a private lawsuit. And on Friday, 19 states — all managed by Democrats — sued the administration over the policy, arguing that DEI policies were necessary.

California is suing the Trump administration over the threat of withdrawing public school funding for diversity, equity and inclusion programs.
Earlier this month, the U.S. Department of Education threatened to cancel funds from schools that do not finish the DEI program. In a lawsuit filed Friday in California federal court, and 18 other states argue that the loss of these funds is “catastrophic.”
“The U.S. Department of Education is negatively waiving its mission to ensure equal access to education with the latest threat of wholesale federal education funds mandated by Congress,” California Attorney General Rob Bonta wrote in a statement. “Again, the President has surpassed his authority under the Constitution and violated the law.”
Ironically, California Proposal 209 passed by voters in 1996 Prohibited “The use of positive behavior in the fields of public employment, public education, and public contracts is to the extent that these programs involve “priority treatment” based on race, gender, color, ethnicity, or national origin.” Dei is even further than employment and enrollment, but California is suing the Trump administration for essentially adopting its own policies.
California voters supported Proposition 209 in 209 by voting for Proposition 16, which sought to reverse Proposition 16. It was the same year that voters in the same year chose Joe Biden, a Democrat, by far more than Donald Trump.
Even more ironic, California Gov. Gavin Newsom (D) signed the Effectiveness Act in 2023, threatening to withdraw funds from school districts that do not comply with the left-wing curriculum on LGBTQ+ issues.
