Chief Justice Roberts Defends Supreme Court’s Role

Chief Justice John Roberts addressed criticism directed at the Supreme Court’s decisions, emphasizing that many political detractors misunderstand the court’s function. During a judicial conference in Hershey, Pennsylvania, he noted that the court’s role is to interpret laws rather than create them.

Roberts commented, “At a very basic level, people think we’re making policy decisions. They see us as saying how things should be instead of what the law stipulates.” He expressed that viewing justices as merely political figures doesn’t accurately reflect their actual responsibilities.

Recently, discussions surrounding the constitutionality of race-based gerrymandering, under the Voting Rights Act, highlighted the court’s political ideology criticism again. Notably, three conservative justices—Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett—were appointed during President Donald Trump’s tenure, contributing to a 6-3 conservative majority.

Roberts made it clear that judicial decisions stem from a legal interpretation and the constitution’s context, not personal policy preferences. He stated, “Thoughtful criticism is beneficial,” while acknowledging that it may not always be as thoughtful as hoped. He also emphasized that the nature of criticism can vary widely.

Despite notable expansions of gun rights and controversial abortion rulings in recent years, public trust in the Supreme Court remains low, hovering around 40%. This drop in approval ratings reflects how political narratives shape public perception, even if the constitutional text itself hasn’t changed.

Roberts remarked, “Our rulings aim to understand the Constitution’s meaning and its applicability to current laws.” He noted that making decisions often leads to unpopularity, which is a necessary aspect of the judicial role.

He cautioned that while criticisms of decisions are valid, they can sometimes devolve into criticisms of the judges, raising significant concerns. The increasing hostility toward judicial decisions puts judges at risk, especially in light of violent incidents involving disgruntled individuals.

Roberts referenced a specific case where an armed suspect was apprehended near Kavanaugh’s residence, reflecting the serious nature of threats faced by judges. He urged awareness around these issues, suggesting that reckless decisions influenced by public pressure could harm the integrity of the judicial system.

As the political climate continues to evolve, questions arise regarding the potential retirements of justices like Thomas and Alito, which could shift the court’s balance ahead of future elections.
