Court Issues Important Decision in Letitia James' Civil Fraud Case Against Trump

New York Court Overturns $5 Billion Fraud Ruling Against Trump

The New York Court of Appeals has overturned a civil fraud ruling that imposed nearly $5 billion in penalties on former President Donald Trump.

The court’s decision comes after the penalties, which exceeded $515 million, were deemed “excessive” by a panel of five judges.

Last year, Judge Arthur Engoron ordered Trump to pay a fine of $355 million, following allegations from New York Attorney General Letitia James that Trump inflated his net worth to secure better loan terms.

“While the court’s injunction aims to address the defendant’s business practices, the nearly $5 billion penalty is an excessive fine that violates the Eighth Amendment of the U.S. Constitution,” the ruling stated.

Two judges on the panel, John R. Higgitt and Llinét M. R, noted that Engoron’s ruling should be nullified and have mandated a new trial.

Another judge highlighted potential political motivations behind James’s case, suggesting that the lawsuit should have been dismissed entirely. Judge David Friedman remarked, “The ultimate aim wasn’t really about market integrity but rather a political agenda that has impacted Trump’s career and his business.”

Presently, James herself is under federal investigation for allegedly using forged mortgage documents to obtain more favorable loan conditions. Attorney General Pam Bondy has appointed Ed Martin as a special attorney to investigate both James and Democratic California Senator Adam Schiff. Reports suggest that the Department of Justice is also looking into whether James violated Trump’s civil rights with the lawsuit.
