Daniel Penny was acquitted by a Manhattan jury and cleared of all charges in Jordan Neely's death. In May 2023, Penny choked Neely on the subway to prevent Neely from harassing passengers.
Neely, 30, was a homeless street performer and Michael Jackson impersonator who screamed, threw things and made threats on the F train in Soho. Penny and other witnesses said Neely was screaming, “Someone is going to die today.”
The homeless street performer was alive when police arrived, but police said they did not want to attempt mouth-to-mouth resuscitation because he was dirty and potentially sick.

“A woman on the train and a witness thanked Penny for saving her life. Another passenger described the abuse as a satanic rant, and many passengers said Daniel Penny “He said he actually kept us safe that day,” she commented, adding, “The fact that he was alive when the police found him is very important here.”
The courage shown by Penny, a former Marine, in this situation is becoming increasingly rare and almost impossible to achieve, especially considering how his life has changed after the incident.
“We have all seen the videos going viral of young women being sexually assaulted and sexually harassed while the men around them do absolutely nothing. They do it because they're cowards, they don't want to cause trouble, or they know this is going to happen to them, especially when there's a black suspect.''
“That's just the way it is, you know that if you have a white person and a black person and the white person just shows up like an aggressor, you're going to lose in the media. You know you're going to lose in the court of public opinion.” she added.
Although Penny did not lose in the court of public opinion this time, Stuckey believes that if Neely's death had occurred four years earlier, a different verdict would have been reached.
“If what happened to Jordan Neely had happened four years ago, I think there would have been a different verdict,” she says. “This is actually very sad, because the verdict shouldn't be dictated by the cultural moment, it shouldn't be dictated by social media outrage, it shouldn't be dictated by protests and the loudness of one side's voice. It should not depend on the facts.”
