Veterans Affairs Department Faces Lawsuit Over Resource Allocation
The Veterans Affairs Department is currently dealing with a lawsuit due to its alleged mishandling of medical resources during the Biden administration, primarily concerning the care of illegal immigrants.
A policy organization based in Washington, after a report from the Daily Signal in August 2024, had requested more details about VA employees being redirected to handle cases for illegal immigrants under the Immigration and Customs Enforcement’s Health Services Corps.
The Center to Advance Security in America, known as CASA, has reported that it received no information in response to its request from the VA.
James Fitzpatrick, the director of CASA, explained, “After we found out that the Biden administration was re-routing resources from the VA to provide medical exams for illegal immigrants, we decided to file a [Freedom of Information Act] request for records and communications.”
“Unfortunately, we didn’t hear back. Now we’re pursuing this lawsuit to acquire the necessary records and inform the public about how VA resources intended for disabled veterans were diverted to provide extensive medical care for illegal immigrants,” he added.
The VA confirmed it received the request for comment but hadn’t replied by the time this piece was published.
This lawsuit, submitted over the weekend in the U.S. District Court for the District of Columbia, aims to compel the VA to disclose emails and other communications concerning the Immigration and Customs Enforcement Health Services Corps, the migrants involved, and the transition of “processors” from the VA to assist with immigration-based tasks.
During the 2023 presidential campaign, Trump criticized then-President Biden for prioritizing the needs of “illegal aliens” over those of homeless veterans. With Trump potentially returning to the White House in January, this lawsuit also looks to highlight the unprocessed Freedom of Information Act requests to his administration.
CASA’s FOIA request in 2024 mentioned a Daily Signal report featuring Army veteran Derick Carver.
Carver, severely injured in Afghanistan in 2010, lost his left leg, part of his right leg, and several fingers. After facing significant health challenges and experiencing issues with VA hospitals, he took notice when he learned about the administration’s redirection of resources towards illegal immigrants, prompting him to speak out.
Carver noted, “The VA was caught moving processors to support [Immigration and Customs Enforcement Health Services Corps] in managing detainee medical needs.”
An estimated 10 million or more illegal immigrants entered the U.S. during Biden’s time in office, many with urgent medical requirements. Carver argued that the quality of care provided to these detainees frequently surpasses that of veterans, and without the bureaucratic hurdles veterans often face.
