DOJ Files Lawsuit Against California Over Emissions Regulations

The Department of Justice (DOJ) has initiated legal action against California concerning its emissions regulations.

On Thursday, the DOJ took this step as part of a broader objective to transition to “zero-emissions” engines by 2036. This move is in opposition to the California Air Resources Board (CARB) regarding the “clean truck partnership,” which aims to mandate that truck manufacturers gradually move away from internal combustion engines.

As per the reports, two separate cases have been presented. These involve guidelines aimed at regulating heavy trucks as well as lightweight vehicles.

“Contracts, partnerships—whatever California calls them—are attempts to disregard federal law,” stated Adam Gustafson, assistant director of the DOJ’s Environment and Natural Resources division. “The Clean Air Act exemption was overturned by President Donald Trump and Congress, which undercuts the basis for California’s actions. CARB needs to adhere to democratic processes and cease enforcing these unlawful standards.”

This lawsuit was initially prompted by complaints from various truck manufacturers, including Volvo.

The DOJ contends that the state has unlawfully attempted to supplant federal environmental regulations.

In June, President Trump approved a Congressional resolution that eliminated the exceptions granted by the Biden administration.

“Without these exemptions, the Clean Air Act is not enforceable. The California Air Resources Board is trying to sidestep this prohibition by enforcing preemptive emissions standards via the Clean Truck Partnership,” the DOJ stated.

According to the DOJ, California is attempting to implement a national prohibition on internal combustion engines for heavy trucks by 2036 through the regulations stemming from this partnership.

“The authority to ban internal combustion engines for heavy-duty trucks lies with the federal government, and such an extensive move has not been approved,” the lawsuit claims. “CARB continues to intimidate truck manufacturers who resist compliance with these preemptive regulations, threatening severe civil penalties and confrontational regulatory oversight.”
