Following Judge Cannon’s ruling on Monday, Smith’s office said the dismissal was inconsistent with past courts’ “uniform conclusions.”

Judge Cannon ruled that Smith was not constitutionally appointed, but the Justice Department argued that Attorney General Merrick Garland has the legal authority to appoint a special counsel.

The scheduled appeal is set to take place on the 11th.Number It will likely make its way to the Circuit Court of Appeals and possibly the Supreme Court.
