Former supporters of Eric Swalwell, the former Democratic Congressman from California, are attempting to reclaim donations made to his campaign prior to the emergence of sexual assault accusations against him. Reports indicate that over 200 donors are seeking refunds totaling more than $1.5 million, based on internal campaign documents. These demands pose a significant challenge for Swalwell, whose campaign funds are crucial for his legal defense regarding the allegations.
Initially, Swalwell’s campaign boasted about $4 million in funds when the allegations surfaced in early April. Subsequently, he took over as treasurer, gaining full control of the finances. Despite the unfolding scandal, he continued to solicit donations, accumulating nearly $200,000 even after the allegations became public.
Federal disclosures reveal that Swalwell may be grappling with substantial debt, including up to $100,000 in student loans and between $30,000 and $100,000 in credit card debt, alongside up to $5 million in mortgage obligations.
California law stipulates that campaign funds spent on legal fees must relate directly to the individual’s role as a candidate or officeholder. However, Swalwell has stepped back from both the Legislature and his gubernatorial aspirations.
A legal expert suggested that Swalwell might argue the allegations surfaced due to his gubernatorial campaign, framing his legal expenses as justifiable. If deemed responsible for any misconduct, he could be mandated to reimburse the donors.
Swalwell has stated, “These sexual assault allegations are completely false… I’m going to fight them with everything I have.” He acknowledged past misjudgments but maintains that they are personal matters.
The first allegations involved multiple women calling out various forms of misconduct, including one claiming that he raped her. Just a day after announcing his intention to resign from Congress, he faced another accusation.
One accuser, Rona Drews, alleged severe abuse, impacting her mental health significantly. After the allegations came to light, many of Swalwell’s donors reportedly expressed feelings of betrayal, with one even declaring a shift in party affiliation due to his dissatisfaction with the Democratic Party.
Swalwell’s withdrawal from the California primary could facilitate a more favorable outcome for Democrats in the election, potentially reducing the odds of two Republicans advancing to the general election, although this remains a possibility within the state’s primary system.
The Swalwell campaign did not respond to requests for comments when reached out by news outlets.
