Denver Public Schools Found in Violation of Title IX
The U.S. Department of Education announced on Thursday that Denver Public Schools (DPS) has violated Title IX, which is designed to prevent gender discrimination in education. The issue arose from the district’s decision to change bathrooms to be all-gender facilities, allowing access based on gender identity rather than biological sex.
This investigation began shortly after President Trump returned to office, specifically in January, when the Civil Rights Office looked into the situation. It followed changes made at East High School in Denver, where girls’ restrooms were converted to all-gender bathrooms, while separate facilities for boys remained on the same floor.
DPS stated that these changes were in response to student input, featuring privacy structures with tall partitions around toilets for security.
Furthermore, the district later added another all-gender restroom on the same floor, claiming it was intended to address concerns about equal access. Students could still use traditional gender-specific bathrooms in addition to the all-gender options, which include single stalls.
The federal government has proposed a resolution requiring the district to agree to several conditions within the next 10 days to resolve the matter and avoid potential enforcement actions.
In the government’s words, “DPS violated Title IX by replacing gender-segregated girls’ toilets with all-gender facilities, which permits students to use restrooms based on their gender identity instead of biological sex.” This raises broader questions about safety, privacy, and equal educational opportunities.
Following this decision, officials expressed concerns over creating a hostile environment for students. They indicated that while schools can support various views on gender identity, they cannot do so at the expense of students’ safety and rights if funded by federal taxpayers.
The proposed resolution also demands that DPS revert to gender-designated multi-stall toilets, re-designate all-gender restrooms, and adopt clearer policies ensuring access based on biological sex rather than self-identified gender.
Additionally, the district is expected to create a memorandum confirming that bathroom access will honor privacy and dignity standards while maintaining equality in educational programs.

Interestingly, under Trump’s leadership, federal initiatives aim to enforce policies that support traditional views on gender, emphasizing biological sex in area schools.
Just recently, House Republicans proposed legislation that would ban transgender girls from participating in sports or using facilities that align with their gender identity rather than biological sex.
