Education Department warns of penalties for Denver schools regarding all-gender bathrooms

The Department of Education is warning Denver Public Schools about potential sanctions due to the Trump administration’s recent actions regarding gender accommodations, specifically focusing on all-gender restrooms.

The Education Department’s Civil Rights Office (OCR) released a statement on Thursday, indicating that Denver Public Schools had violated Title IX of the Education Amendments of 1972, along with its implementation regulations.

The OCR determined that the district’s policy to transform gender-segregated multi-stall toilets into all-gender facilities is part of the “Denver Public Schools LGBTQ+ Toolkit.” This policy allows students to access bathrooms that align with their gender identity rather than their biological sex.

This investigation began in January when the Department looked into the district’s decision to change girls’ restrooms into all-gender facilities.

The OCR noted that by converting designated girls’ toilets at East High School into all-gender restrooms, the district violated Title IX. This move permits students to use facilities based on their gender identity rather than biological sex.

Consequently, the OCR stated that the district’s actions create a hostile environment for students, compromising their access to equal educational opportunities and putting their safety, privacy, and dignity at risk.

The OCR has proposed a “suggested resolution agreement” to Denver schools to address the Title IX violation.

The district was given the option to voluntarily agree to this within ten days, or they could face immediate enforcement actions, according to the department.

Attempts to reach out to Denver Public Schools for a response were made.

President Trump has consistently sought to limit the rights of transgender individuals and has taken steps against schools that align with their identities. Recently, House Republicans introduced legislation that would bar transgender girls from participating in sports teams and using restrooms that correspond to their gender identity.
