Retired Justice Kennedy calls for civil political discourse at legal forum

Former Supreme Court Justice Anthony Kennedy spoke on Thursday about the need for a more civil political discourse, advocating for respect and dignity in discussions, particularly in a legal forum aimed at shielding the judiciary from attacks.

“We should be concerned about the tone of political discourse in this country,” Kennedy remarked during a virtual event organized by nonpartisan groups.

He emphasized that reducing individuals to identity politics or partisan labels does not foster healthy democratic debate. Instead, he argued that the focus should be on treating everyone with respect and dignity.

“This is what judges do, and it’s why they are so crucial,” he added.

This virtual appearance was notable, as it marked a rare public engagement for Kennedy, who left the bench in 2018.

His comments come amid significant legal challenges facing the current administration, prompted in part by criticisms from President Trump and his supporters. While Kennedy didn’t specifically mention Trump, he reflected on America’s image abroad, particularly in relation to ongoing conflicts in the Middle East.

“If they observe a hostile and fractious discourse and see identity politics overshadowing substantive discussions, then democracy—and freedom—are at stake,” Kennedy stated.

The former justice also highlighted the rising threats against judges since Trump returned to the White House. A report from the New York Times revealed that 162 judges faced threats just weeks after March 1, a stark increase from the 80 threats noted five months prior.

Kennedy proposed that judges might protect themselves by consistently demonstrating commitment to resolving conflicts in a civil manner.

Ultimately, he underscored that the overarching goal for all Americans should be to “preserve freedom and enhance it” for future generations.

“We must always reject tyranny and embrace the truth,” the retired justice concluded.
