Judge Dismisses Indictment for DOJ Employee Who Assaulted Officer with Sandwich

A federal judge recently rejected a motion from prosecutors to indict a former Department of Justice (DOJ) employee who reportedly assaulted a federal officer with a sandwich.

This incident involved Shawn Charles Dan, who was let go from the DOJ after throwing a subway sandwich at a Customs and Border Protection agent. Dan had previously been part of the International Affairs section within the DOJ’s Criminal Division.

Prosecutors aimed to charge him with felony assault on a federal officer, but the DC grand jury chose not to bring forward the indictment.

Typically, grand jury proceedings are conducted in secrecy to assess whether there’s enough evidence for charges, and it’s still possible for prosecutors to pursue another case against Dan in the future.

A video circulated online captures Dan, upset and wearing a pink polo and light shorts, conversing with a small group of agents while holding a subway sandwich. In a sudden outburst, he tossed the sandwich at the officer’s chest and fled, prompting at least three officers to pursue him.

“I just found out that this person used to work for the Department of Justice—well, not anymore,” Bondi remarked in a recent post. “This illustrates the deep state we’ve been contending with as we work to reform the DOJ. You won’t be part of this administration if you undermine our government and law enforcement.”

As the situation develops, Attorney General Pamela Bondi emphasized on social media that any physical interaction with law enforcement will be met with serious repercussions. Moreover, she reiterated that Dan’s actions underscore challenges faced by the administration over recent months.
