Trump’s Civil Fraud Appeal Analysis

Greg Jarrett, a legal analyst for Fox News, expressed on Thursday that President Donald Trump may have a solid chance in his New York civil fraud appeal against Attorney General Letitia James, a Democrat. The New York State Supreme Court recently chose to dismiss the remaining civil fraud judgment linked to James’ business activities, characterizing the case as an unusual use of prosecutorial authority.

During his appearance on “Evening Edit,” Jarrett discussed the likelihood of Trump successfully overturning the case, especially since James is appealing to maintain a hefty fine of nearly $500 million that an earlier court deemed excessive. He stated, “He definitely has a case, Liz. Civil fraud cases have often been legally ludicrous. And, of course, this seems like a political grudge and a misuse of power on James’ part.” According to Jarrett, James ran her campaign with the intention to target Trump, implying that she had pre-determined her approach even before examining any evidence.

Jarrett criticized the trial court’s ruling, arguing that it was fundamentally flawed, suggesting that the misconduct findings against Trump should also be reversed. He noted that Judge Arthur Engoron had shown bias in the decision-making process, which was later overturned on appeal. “Trump seeks to nullify the remaining fraud findings, which he should because none were truly misled. Financial experts who evaluated the situation agreed with Trump’s property assessments,” Jarrett explained. He pointed out that 12 experts in fields like accounting, finance, and real estate testified that Trump acted appropriately, while the attorney general only presented dubious estimates.

In a significant ruling in August 2025, the New York Court of Appeals imposed a near $500 million fine on Trump for civil fraud, labeling it as “excessive.” This followed an earlier order in February 2024 where Engoron found Trump liable for civil fraud tied to his asset valuations. Although the appellate ruling invalidated the fine, numerous legal disputes surrounding the case’s findings remain unresolved as both parties continue to contest central aspects of the decision.
