How indicted NY AG Letitia James will cover her legal expenses — which may reach $10M: experts

New York Attorney General Faces Legal Battles

ALBANY – New York State Attorney General Letitia James is bracing for a hefty legal battle, potentially costing millions in taxpayer money as she confronts new federal charges. However, she has stated that she won’t tap into the state’s $10 million legal defense fund, which was established for such situations.

Instead, she plans to seek assistance from the National Democratic Lawyers Association to help fund her defense against serious mortgage fraud allegations announced recently. Legal analysts estimate her defense could cost between $5 million and $10 million.

According to former prosecutor Neema Rahmani, James has engaged a well-known defense attorney, Abby Lowell, whose fees are around $1,000 an hour. This could lead to legal fees nearing $1 million.

Interestingly, some lawyers might consider taking on James’s defense pro bono, given the case’s political implications and her affiliation as a Democrat. “Many talented attorneys could come forward and offer their services for free,” remarked former prosecutor Duncan Levin.

A spokesperson from James’s office confirmed that while there had been initial thoughts of using state funds, they will not be utilized for her defense.

The state auditor’s office has verified that no funds from the $10 million reserve have been withdrawn so far. The creation of this fund slipped into the state budget earlier this year, prompting considerable pushback from Republican lawmakers before it was ultimately passed in a Democratic-led Congress.

James adamantly denies the charges against her, asserting that former President Trump is targeting her for political reasons.

A court appearance is scheduled for her on October 24th in Virginia.

As for the upcoming gubernatorial race, the current governor is seeking re-election. Over the summer, Hochul showed support for her own campaign, putting to rest any ideas she had about challenging James in a primary, a suggestion she did consider prior to the 2022 race.

Since her election in 2018, James has an annual salary of $220,000. Additionally, her 2024 financial disclosure revealed earnings between $5,000 and $20,000 from her role as an adjunct professor at Columbia University and between $20,000 and $50,000 from a rental property in Brooklyn.

Recently, the Democratic Attorneys General Association (DAGA) has announced a legal defense fund aimed at supporting Democratic attorneys general targeted by Trump, creating a pathway for funding James’s legal needs.

It’s currently unclear who is backing this fundraising initiative and the total amount of funds that James possesses. The donation webpage for the DAGA Legal Defense Fund indicates that contributions might not remain confined to just this effort, suggesting broad use for various programs under DAGA’s discretion.

Overall, if managed effectively, this fund has the potential to aggregate considerable contributions from a host of supporters, including companies and individuals in advocacy roles.

DAGA has yet to respond to inquiries regarding these developments.
