Hunter Biden Defeated in Attempt to Throw Out Tax Case

Hunter Biden’s effort to have all tax charges thrown out was defeated Monday, allowing the criminal case against him to move forward.

The ruling confirms that Biden faces three felonies and six misdemeanors related to tax evasion, false returns and failure to pay taxes from 2016 to 2019.

Mr. Biden has pleaded not guilty to all charges.

As Breitbart News reported, his lawyers argued last month that the case was politically motivated and tainted by two IRS employees who later became whistleblowers.

The president’s son filed eight separate motions to have the charges dismissed, each citing different legal grounds, including immunity claimed from past plea deals he negotiated.

U.S. District Judge Mark Scalsi ruled that the case was not political and set aside Biden’s main arguments, noting that Biden’s lawyers had not presented evidence of their claims.

“This motion is notable in that it does not include a single request for declarations, evidence, or judicial notice,” he wrote. “Instead, the defendant cites portions of various internet news sources, social media posts, and legal blogs. However, these citations are not evidence.”

Scalci added that the sources, primarily media reports about the incident, “contain multiple levels of hearsay.”

The Hill report said the judge similarly rejected Biden’s claims of selective and retaliatory prosecution.

“Defendants have failed to present any reasonable inference of discriminatory effect or discriminatory purpose, let alone clear evidence,” Scalsi wrote.

“Thus, the selective prosecution claim fails.”

Hunter Biden could face up to 17 years in prison if convicted. The president’s son faces a total of 42 years in federal prison for nine tax and three firearms charges.

He was charged with firearms violations in Delaware and has pleaded not guilty, but remains a key witness in the House impeachment inquiry against President Joe Biden.
