A federal judge in California on Monday objected to Hunter Biden’s attempt to dismiss tax charges and allowed the criminal case against the president’s son to proceed.
The younger Biden faces three felonies and six misdemeanors related to tax evasion, false returns and failure to pay taxes between 2016 and 2019. His lawyers argued last month that the case was politically motivated and was later tainted by two IRS agents. He became a whistleblower.
He filed eight separate motions to dismiss the charges, each citing different legal grounds, all of which were denied.

“This motion is notable in that it does not include a single request for declarations, evidence, or judicial notice,” he wrote. “Instead, the defendant cites portions of various internet news sources, social media posts, and legal blogs. However, these citations are not evidence.”
Scalci added that the sources, primarily media reports about the incident, “contain multiple levels of hearsay.”
The judge similarly rejected Biden’s claims of selective and retaliatory prosecution.
“Defendants have failed to present any reasonable inference of discriminatory effect or discriminatory purpose, let alone clear evidence,” Scalsi wrote. “Thus, the selective prosecution claim fails.”
Biden’s lawyers also cited two former IRS officials who later served as witnesses in the House Republican inquiry into Biden, calling for the lawsuit to be terminated due to “outrageous government conduct.” Stated.
But Scalsi disagreed, pointing out that there is no precedent for dismissing a case based on “outrageous government conduct” and that Biden’s claims do not meet the high standards for removal from office.
The California tax case is one of two that Biden faces as a result of special counsel David Weiss’ investigation into him. The president’s son has also been charged in Delaware with three gun-related charges, to which the president has maintained his innocence. His plea of innocence came after a plea deal between him and prosecutors collapsed last year.
