Judge Appointed by Biden Stops FTC Probe into Media Matters, Cites First Amendment Breach

A judge appointed by President Biden has stopped the Federal Trade Commission (FTC) from investigating a left-leaning organization, which is accused of coordinating media efforts to push an advertiser boycott for X. There’s a claim that the Trump administration is attempting to limit the group’s free speech.

U.S. District Judge Sparkle L. Souknanan, serving in the District of Columbia, issued an injunction on Friday, which obstructed the initial FTC investigation. This was initially reported by the Associated Press in May.

Souknanan pointed out that the FTC’s investigation aimed to “look into advertisers’ boycotts on social media platforms,” which she deemed a violation of the First Amendment.

“When the government retaliates against anyone for participating in a constitutionally protected public discourse, it should raise concerns for all Americans,” she stated.

A document obtained by Reuters as part of the investigation indicates that the FTC is pursuing all documents linked to media matters due to an ongoing lawsuit initiated in 2023 by X’s owner, Elon Musk.

The FTC was trying to gather details about communications with similar organizations affiliated with Democrats based in Washington, D.C.

Media controversies are frequent, as demonstrated when Breitbart News, along with its late founder Andrew Breitbart, targeted ABC News, leading to the network dropping a conservative perspective during the 2010 midterm elections.

“This situation revolves around media influence, including the pandemic narratives and the overwhelming liberal presence from outlets like the Huffington Post,” Breitbart asserted back then. “This is about yielding to leftist pressure… they realize they have the power to shape discourse, and ABC gave in to that.”

After ABC’s decision regarding Breitbart, Media Matters’ founder and CEO David Brock responded, saying, “I’m glad that ABC has come to this realization; it shows a disconnect with Andrew Breitbart’s viewpoint.”

He continued to amplify his criticisms.

In May, Media Matters referred to the FTC investigation as a “danger posed” by the Trump administration, according to a statement in the New York Times.

“The presence of right-wing media figures in significant governmental roles and their misuse of power against critics has characterized the Trump administration,” he mentioned in a statement Thursday. “Threats are ineffective. Our mission will continue unabated.”

After Souknanan’s injunction, Calthorne remarked, “The court’s decision highlights the necessity of standing firm against undue pressure from the Trump administration.”
