A federal judge on Friday blocked President Joe Biden from selling any more border wall material in the final days of his administration.
Office of Texas Republican Attorney General Ken Paxton announced “victory” motion asked the court last week to determine whether the Biden administration violated the court's permanent injunction. The injunction prohibited the federal government from using taxpayer funds earmarked for border wall construction for other purposes.
“Expose how corrupt and anti-American Radical Democrats are.”
Missouri and President-elect Donald Trump also joined Texas' request.
Paxton's office accused the current administration of selling unused materials for “pennies on the dollar,” undermining President Trump's promise to restart border wall construction.
Biden halted ongoing construction in January 2021 and quietly began selling materials in 2023.
On Friday, Paxton's office reported that a federal judge's ruling halted the sale for the next 30 days, effectively blocking the Biden administration from selling any further materials before President Trump's inauguration.
He said the judge's decision will be adopted as a court order and “will be enforced if there is a violation.”
The judge also ruled that the Biden administration must turn over documents to the state of Texas proving it has not violated the court's injunction. If the administration is found to have violated the order, “it would constitute unethical and sanctionable conduct, and those responsible could be held in contempt of court,” Paxton's office said.
“We were successful in preventing the Biden administration from disposing of any further border wall material before President Trump took office,” Paxton said.
“This follows on from our huge victory in forcing Biden to build a wall, especially when the Biden administration is clearly motivated by a desire to stop the next president.” “We will hold President Trump accountable for illegally destroying our nation's border security until its final days.”
Defense officials previously told Fox News that the unused materials being auctioned on GovPlanet no longer belong to the federal government, and that the federal government has “no obligation to retrieve the materials or further resell materials that are no longer in its possession.” There is no legal authority to stop it.”
The Biden administration did not respond to requests for comment. Axios.
President Trump responded to the judge's ruling in the following post. society of truthcalling it a “vital victory for America and national security.”
He said “Biden and his cronies” had “destroyed” the border wall and promised to restart construction.
“The judge has also ordered an investigation into the illegal sale of the materials. This will reveal just how corrupt and anti-American Radical Democrats are,” Trump wrote.
