Judge Blocks ICE Arrests in Los Angeles Over Claims of Racial Profiling

Federal Judge Challenges Immigration Enforcement in California

A federal judge based in Los Angeles is attempting to halt the enforcement actions of Immigration and Customs Enforcement (ICE) under claims of illegal profiling against California residents.

This ruling comes from Judge Maame Ewusi-Mensah Frimpong of the U.S. District Court for the Central District of California, who issued two suppression orders late Friday. Judge Frimpong was appointed by President Joe Biden and is the daughter of Ghanaian immigrants, with historical ties to both Harvard and Yale.

In response to the ruling, White House spokesperson Abigail Jackson remarked, “Federal judges have no authority to direct immigration policies. That power rests with Congress and the President.” She emphasized that proper planning and execution are essential for enforcement operations, and that such decisions exceed judicial authority. There’s an expectation that this judicial overreach will be corrected upon appeal.

The judge determined that criteria such as a suspect’s race, language barriers, location in areas known for employing undocumented workers, and type of work did not constitute “probable cause” for arrests. Furthermore, the ruling prohibits ICE from conducting searches through routine patrols and encourages the agency to assist migrants in obtaining legal support.

This restraining order is set to last for 14 days, though there’s a likelihood of an extension being sought by the judge.

Democratic leaders have expressed their approval of the ruling.

Within the Central California district, there are over one million undocumented immigrants. The state’s economy relies heavily on this workforce, but this reliance has also contributed to significant income disparities and pushed many middle-class individuals out of the area, reinforcing the political influence of the Democratic party.

U.S. Attorney Bill Essayre defended the actions of federal agents, asserting that they have never detained anyone without proper legal grounds. He stated, “Our federal agents will continue to enforce the law and comply with the U.S. Constitution.”

Additionally, a statement from the Department of Homeland Security critiqued the ruling, claiming that district judges are undermining the will of the American people. The statement highlighted the successful efforts of law enforcement in apprehending dangerous individuals, maintaining that law and order prevail.
