A judge in Massachusetts has issued a ruling blocking the State Department’s attempt to enforce an executive order from Trump regarding gender identification on passports. This order would have mandated that individuals needing to renew their passports or change their name or gender designation would have to do so within a year before expiration, reflecting their biological sex.

The ruling allows passport applicants to still select “X” on their forms for gender. It seems significant, especially given the affiliations of the judge involved. Judge Julia Covik has established ties with the Democratic Party. She was appointed by President Biden and boasts a noteworthy résumé, including her role as a clerk for former Supreme Court Justice Ruth Bader Ginsburg and experience in the Massachusetts Attorney General’s office under Governor Maura Healy.

Covik has also been active in various Democratic campaigns over the years, from helping out in John Kerry’s presidential run in 2004 to supporting local races. In her judicial nomination process, she disclosed her volunteer work for several Democratic candidates, which might raise some eyebrows about her impartiality in this ruling.

Her decision points out two main changes made by the State Department in 2025: firstly, it eliminated the option for individuals to select their gender identification, and secondly, it removed the “X” designation previously available for individuals who are intersex or non-binary. Covik’s injunction aims to reverse these changes, reflecting perhaps a broader conversation about gender identity and policy in the U.S.

The State Department’s new policy aligns passports with individuals’ biological sex at birth, moving away from the self-identification approach established during the Biden era. Covik’s ruling extends a previous injunction related to rejecting passport applications that reflect transgender and non-binary identities, illustrating an ongoing legal tug-of-war surrounding these issues.
